This question from Chief Justice Roberts is floating around the ether and is quickly becoming a running joke. Here’s the thing. It sounds like a good story. I mean the Supreme Court is listening to arguments about a sexting case which involves a hardcore (no pun) police officer who is a member of his SWAT team, his wife and a mistress. Sex and the justices? Count me in baby!
BUT if you seriously think that our Supreme Court justices who are arguably a crazy smart bunch of people do not know the difference between email and a pager, then I have some Goldman Sachs derivatives to sell you – cheap.
For those of you who do not know, a transcript of all of the Supreme Court’s arguments is available online. Isn’t it great to be an American? On Page 29, Line 6, Chief Justice Roberts states the following: “Maybe – maybe everyone else knows this, but what is the difference between the pager and the e-mail?”
Roberts is asking what is the difference between how the pager and email are controlled and monitored by the police department.
Alas, I read all 70 pages or rather 58 pages and skimmed the glossary, but there were no reprints of what Justice Scalia referred to as “spicy conversations”.
